User agreement / public offer (offer) of the online store https://eu.siz-zis.com on the sale of goods.

 

This offer (offer) is addressed to an unlimited number of persons wishing to purchase the Goods in the online store https://eu.siz-zis.com (hereinafter referred to as the Online Store). The Offer defines the rules and procedure for the sale of the Goods through the Online Store, as well as regulates the relationship between the Buyer and the Seller when selling the Goods through the Online Store and providing services in connection with such sale. The Buyer wishing to purchase the Goods in the Online Store should carefully read the terms and conditions contained in this Offer and, if agreed, accept the terms of the Agreement below.

 

Subject of the Agreement.

The subject of this Agreement is to enable the Buyer to purchase for personal needs not related to the conduct of business activities the Goods presented in the catalogue of the online store (hereinafter referred to as the "Store" on the Site), under the terms of this Agreement.

This Agreement governs the sale and purchase of the Goods in the Online Store, including

- voluntary selection of the Goods by the Buyer in the Online Store;

- independent execution of the Order by the Buyer in the Online Store;

- payment by the Buyer for the Order placed in the Online Store;

- processing, delivery and transfer of the Order to the Buyer under the terms of this Agreement.

The relationship between the Seller and persons wishing to purchase the Goods for business purposes shall be governed by separate agreements.

 

Basic concepts

Website - a set of information resources located on the Internet at https://eu.siz-zis.com Online Store - an Internet site located on the Internet at https://eu.siz-zis.com/shop, which presents the Goods offered by the Seller for purchase, as well as the terms of payment and delivery of the Goods to the Buyers. Website User - a visitor to the Website https://eu.siz-zis.com Buyer - an individual, a visitor to the Website who has accepted the terms of this Agreement and intends to order or purchase the Goods, or a customer who purchases the Goods solely for personal needs not related to the conduct of business. Sale of the Goods through the Online Store means the sale of the Goods by concluding an electronic transaction on the basis of the Buyer's acquaintance with the description of the Goods offered by the Seller contained in the catalogue of the Online Store, which excludes the possibility of direct acquaintance of the Buyer with the Goods at the time of concluding such a transaction. Goods - products presented for sale on the Seller's Website. Delivery Service - a company specialising in the carriage and/or delivery of goods (including, but not limited to: "Nova Poshta", "In Time", "Delivery", "Bridge Express", etc.) Offer - information posted on the Website about a particular Product that can be purchased by the Buyer. The Offer includes: information about the Goods, information about the price of the Goods, payment and delivery methods, as well as other conditions for the purchase of the Goods by the Buyer. The terms of the Offer are determined by the Seller. The Offer is not an offer, but only information about possible ways to purchase the Goods. The Offer is an invitation to make offers to conclude a contract of sale of the Goods. Personal Account - a section of the Online Store available to the User after Registration, through which the latter manages his/her account (account). Registration - filling in the appropriate form on the Website by the Buyer/User indicating the data necessary for identification, followed by entering the Customer's personal (personal) data into the Seller's database. Status message - a message sent by the Seller to the e-mail or mobile number of the Website User and containing information about the status of the Order, Registration, access to the Personal Account, etc. Messages of this type may be received by the Site User when performing the relevant actions (Registration, placing an Order, etc.) and do not require additional consent to receive them. Informational message - a message sent by the Seller to the Client's e-mail or mobile number and containing information about special offers, promotions, news of the Seller and other messages.

 

General provisions

The Seller sells the Goods through the Online Store at https://eu.siz-zis.com. By ordering the Goods through the Online Store, the Buyer agrees to the terms and conditions of sale of the Goods set forth in this Agreement. In case of disagreement, the Buyer shall not order the Goods through the Online Store. These Terms and Conditions of Sale of the Goods, as well as information about the Goods presented on the Website, are a public offer in accordance with Article 641 of the Civil Code of Ukraine and Article 11 of the Law of Ukraine "On Electronic Commerce", which is an invitation to make offers to enter into a contract for the sale of the Goods. The Agreement shall enter into force (be deemed concluded) upon receipt by the Seller of the Order duly executed by the Buyer, which shall contain, at least: - surname, name, patronymic, e-mail address, contact phone number of the Buyer or the person indicated by him (the Recipient), - name, quantity and price of the Goods; - method and address of delivery of the Goods; - method of payment for the Goods. The Seller has the right to unilaterally change the terms of this Agreement at any time. Changes shall take effect from the moment a new version of the Agreement is posted on the Website.

Registration on the Website

Registration on the Site is carried out at https://eu.siz-zis.com/shop By registering on the Site, the Buyer undertakes to provide reliable and accurate information about himself and his contact details for the Seller to fulfil his obligations to the Buyer and deliver the Goods to him. Registration on the Website is not required to place an Order. The Seller shall not be liable for failure to fulfil its obligations if the information provided by the Buyer during registration is inaccurate or incomplete. The Buyer undertakes not to disclose to third parties his login and password specified during registration. In case the Buyer suspects that his login and password are not secure or may be used by third parties, the Buyer shall immediately notify the Seller thereof by sending a corresponding e-mail from the Personal Account or by e-mail to the address: sales@plamis.com. The Buyer is solely responsible for all actions performed on behalf of the Buyer, that is, using his login and password.

Product information, Product price

Photos of the Goods presented on the Website may differ from the actual appearance of the Goods. The description and specifications accompanying the Goods on the Website are provided for reference only. The Online Store does not guarantee the accuracy and completeness of the information about the Products presented on the Website. To clarify information about the Goods, the Buyer may contact the store's consultants at the contacts indicated on the Site. The Seller may at any time without prior notice make changes to the description/characteristics and/or photographs of the Goods. The Online Shop shall not be liable for any damages (including, but not limited to, damages from loss of profit, data or business interruption) arising from the use, inability to use or results of using the Website. The price of the Goods presented on the Website is indicated in UAH excluding VAT. The Buyer agrees that the price of the Goods placed in the "Basket", its assortment and quantity will be relevant only at the time of the formation of the "Basket" and may change until the Order is confirmed. The price with discounts or promotional offers is indicated in the "Basket" when placing the Order. By clicking the "Confirm Order" button, the Buyer agrees to purchase the Goods at the price specified in the "Basket". The price of the Goods on the Website may be changed by the Seller unilaterally. The Seller has the right to provide discounts on the Goods, hold promotions, set special prices for the Goods. The types of discounts, the procedure and conditions for their accrual are indicated on the Website in the "Cart" section (or other sections) and may be changed by the Seller unilaterally. In case of incorrect indication of the price of the Goods ordered by the Buyer, the Seller shall inform the Buyer about this to confirm the Order at the corrected price or cancel the Order. If it is impossible to contact the Buyer, such an Order is considered cancelled. If the Order has been paid, the Seller shall refund to the Buyer the amount of money paid for the Order.

 

Placing an Order

The Buyer independently places an Order by freely selecting the desired Goods, moving it to the "Cart" section and confirming it by clicking the "Confirm Order" button or by phone. After placing the Order, the Buyer will be sent a notification of receipt of the Order to the contacts specified when placing the Order (e-mail and/or mobile phone message). When placing an Order by phone, notification is carried out by telephone or by sending an SMS message to a mobile number. In case of absence of the Goods ordered by the Buyer in the Seller's warehouse, the latter has the right to cancel the Buyer's Order by notifying the Buyer by calling the Online Store consultant, by letter or by sending a message to the mobile number. In case of cancellation of a prepaid Order, the cost of the Goods shall be returned by the Seller to the Buyer. By placing an Order, the Buyer confirms his/her acceptance of the terms of this offer and agrees to the processing of his/her personal data. The Buyer confirms that he has read the section of the Site "Delivery and Payment", agrees with it and understands it fully. The Seller reserves the right to change the delivery time of the Order by notifying the Buyer of such changes. The Buyer bears the risk of adverse consequences for providing false information that has caused the Seller to be unable to properly fulfil its obligations to the Buyer. In order to confirm the Order, the Buyer may be contacted by the consultant of the Online Store, who clarifies the details of the Order, agrees on the date and time of delivery. Confirmation of the Order can take place without a call from the consultant by e-mail or a message to the messenger (Viber, Telegram, etc.) specified by the Buyer when placing the Order. The Seller has the right to refuse to transfer the Order to the Buyer if the data specified by the Buyer when placing the Order is incomplete or suspected of being unreliable. In case of cancellation of a prepaid Order, the cost of the Goods shall be returned by the Seller to the Buyer. In the absence of the ordered Goods, the Buyer has the right to replace it with another Goods or cancel the Order by notifying the Seller by phone or by sending a message to the messenger (Viber, Telegram, etc.) specified by the Buyer when placing the Order.

Delivery of the Goods

Possible delivery methods, approximate terms and territory of delivery of the Goods are indicated on the Website in the section "Delivery and Payment". The approximate delivery time and date shall be agreed by the Buyer with the consultant of the Online Store when confirming the Order. Upon delivery, the Goods shall be handed over to the Buyer or to the third party specified in the Order (Recipient). If the above persons cannot receive the Goods, the Goods may be delivered to a person who can provide information about the Order and pay the cost of the Order in full. In this case, the Seller's obligations shall be deemed to be duly fulfilled. When delivering the Goods, the representative of the Delivery Service (courier) has the right to request an identity document of the Recipient. The ownership of the Goods shall be transferred to the Buyer at the time of transfer of the Goods and subject to payment of the full value of the Goods. The risk of accidental complete destruction or partial damage of the Goods shall be transferred to the Buyer at the time of transfer of the Goods and signature by the Buyer/Recipient on the documents confirming its delivery. In the event of non-delivery of the Goods, the Seller shall reimburse the Buyer for the cost of the Order and delivery prepaid by the Buyer in full upon receipt of confirmation of the loss of the Goods or their return to the Seller's warehouse from the Delivery Service. The cost of delivery: - When the Buyer orders the Goods for the amount indicated on the Site in the "Delivery and Payment" section as entitling to free delivery or above this amount (including discounts), delivery is free of charge (at the expense of the Seller). - If the Buyer orders the Goods for an amount less than the amount at which the right to free delivery arises, the cost of delivery shall be determined at the rates of the Delivery Service and paid by the Buyer. The Seller's obligation to transfer the Goods to the Buyer shall be deemed fulfilled upon delivery of the Goods to the Buyer/Recipient or receipt of the Goods at the offices of the Delivery Services and/or from the couriers of the Delivery Services. If the Goods were not purchased on a prepayment basis, the Recipient shall, upon receipt of the Order, check the integrity of the packaging and, if there is no visible damage, pay the amount of the Order. In case of damage or defects of the Goods, the Goods may be returned at the request of the Buyer.

Payment for the Goods

The Buyer has the opportunity to pay for the Order in one of the ways specified on the Website in the "Delivery and payment" section.

 

Return of the Goods and funds

The Goods of inadequate quality are the Goods containing defects. A defect of the Goods is its non-compliance with the requirements of regulatory legal acts, the terms of the contract or the requirements for it. The received Goods shall correspond to the description on the Website. The difference between the design or decoration elements and the description stated on the Website is not a sign of inadequate quality. If the Buyer has received the Goods of inadequate quality, the Buyer has the right to use the provisions of Article 8 of the Law of Ukraine "On Consumer Protection" - to demand replacement with the Goods of proper quality or to demand termination of the contract and refund of the amount paid for the Goods. Claims (application) for the return of the amount of money paid for the Goods of inadequate quality shall be satisfied in accordance with the requirements of the law, starting from the date of submission of the relevant claim. Refunds are made by refunding the cost of the paid Goods.

By filling out the registration form on the Website https://eu.siz-zis.com and/or placing an order for the Goods, the Buyer agrees to the collection and processing of his personal data by the Seller, as well as information about consumer preferences and purchases in the Seller's stores, in accordance with the Law of Ukraine No. 2297-VI of 01 June 2010 "On Personal Data Protection". The Buyer's personal data is processed in accordance with the Law of Ukraine "On Personal Data Protection". Purpose of personal data processing. The data provided by the Buyer during Registration or placing an Order through the Site will be used to process Orders for the purchase of Goods, receive information about the Order, send via telecommunication means (e-mail, mobile communication), advertising offers, information about promotions, drawings, special offers or any other information about the activities of the Seller or its partners, for other commercial purposes. The owner of personal data is the Seller. The Seller guarantees the confidentiality and protection of Buyers' personal data. The Buyer gives the Seller the right to process his personal data, including: to include personal data in the database (without additional notice), to carry out indefinite data storage, accumulation, updating, change (if necessary). The Seller undertakes to ensure the protection of data from unauthorised access by third parties, not to distribute or transfer data to a third party (except for the transfer of data to commercial partners, persons authorised by the Seller to directly process data for the specified purposes, including mobile operators, postal or courier delivery services, contact centres, advertising agencies, as well as at the request of the competent state authorities in accordance with the procedure established by law).

 

Information messages and mailing

From time to time, the Seller may send newsletters and/or informational messages by sending them to the email addresses of the Buyers who purchased the Goods in the online store https://eu.siz-zis.com and/or participated in promotions and/or other marketing activities (contests, prize/gift draws, etc.). The basis for receiving the newsletter and/or information message is the Buyer's consent to such mailing, executed by indicating the e-mail address and/or mobile phone number that the Buyer has provided on his/her own initiative in the relevant questionnaire or when placing an Order in the online store https://eu.siz-zis.com or in case of self-subscription to receive newsletters and information messages on the Site. The Buyer can unsubscribe from receiving the newsletter at any time through the appropriate functionality in the body of the newsletter (by clicking on the "Unsubscribe" link at the bottom of the letter).

Additional terms and conditions

The Online Store and the services provided therein may be temporarily partially or completely unavailable due to preventive or other works or for any other technical reasons. The technical service of the Seller has the right to periodically carry out the necessary preventive or other work with or without prior notice to the Buyers.
